These Terms of Use govern access to the Paint-by-Number Studio website operated by Roth Technical Consulting, LLC.
Website information
The website provides information about software that is still being prepared for commercial release. Features, prices, system requirements, availability, and launch timing may change before purchase becomes available.
Software license controls
Use of Paint-by-Number Studio is governed by the End User License Agreement supplied with the software or accepted during purchase or activation. If these website terms conflict with that agreement regarding use of the software, the software license agreement controls.
Trial use
Any evaluation version is offered solely for evaluation under its stated time, export, watermark, and functional limitations. Trial restrictions may not be bypassed or removed.
Personal and commercial use
A Personal license is intended for permitted personal and hobby use. Business, revenue-generating, kit-production, or other commercial use requires the applicable Studio Commercial license, as defined in the final license agreement.
User content
You are responsible for having the rights and permissions necessary to use every photograph, image, logo, likeness, trademark, or other material submitted to the software or an optional AI service. You retain ownership of your source material, subject to third-party rights and the terms of any service you choose to use.
Optional third-party services
AI-assisted features require a customer-provided API key and may create separate charges from the service provider. Stripe, OpenAI, Cloudflare, paint manufacturers, and other third parties have their own terms and policies. Roth Technical Consulting, LLC does not control those third-party services.
Intellectual property
The website, software, documentation, branding, design, and original content are owned by Roth Technical Consulting, LLC or used with permission and are protected by applicable intellectual-property laws. Product and company names belonging to others remain the property of their respective owners.
Prohibited conduct
You may not interfere with the website, attempt unauthorized access, distribute malware, misuse payment or download systems, circumvent licensing controls, or use the website or software unlawfully.
Disclaimers
The website is provided on an “as available” basis. To the extent permitted by law, we do not warrant uninterrupted access or that every description will remain unchanged before release. Software warranties, if any, are stated in the applicable license agreement.
Limitation of liability
To the extent permitted by law, Roth Technical Consulting, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of this website. Rights that cannot legally be excluded remain unaffected.
